While I was walking my dog about two weeks ago; an older neighbor lady angerily stated that she was going to report me for my dog being over 30 pounds. The HOA rules used to state 50 pounds or less. My dog weighed 44 pounds when I adopted him from the Arizona Humane Society.

On October 28, 2013 I received the following certified letter dated October 22, 2013:

' Dear Homeowner: We understand that it is often difficult to keep up with home maintenance. However, it is important to the community as a whole that all homes in Holiday Gardens, Inc. are well maintained. You are hereby notified that there is a problem with the following: 1) a large aggressive dog over 30 lbs. Please 1) Remove all dogs of the aggressive breeeds noted in the rules and regs, There is a limit to one animal if it meets the requirements. Your dog has been reported as aggressive and over 30 lbs. This letter is the first notice of your violation of the Holiday Gardens, Inc. The board of directors is taking all violations very seriously and will fine every 15 days for noncompliance of each violation. Arizona law provides that the Association has the authority to assess reasonable fines for those homeowners who do not comply with the standards. Violations of the Holiday Gardens, Inc. Amended Declaration of Restrictions are subject to a fine according to the fine schedule. You may request a hearing with the Board of Directors to resolve this matter. If you would like a hearing, please submit a written request within ten (10) days from the date of this letter. Your written request should be mailed to the association at the above address.'

My response: TO WHOM IT MAY CONCERN: On this date 10-28-13 I received a letter from the Holiday Gardens Home Owners Association regarding my dog. I have been living here since August of 1995 and this has not been an issue. My current dog is well behaved and is current with all of his shots. I do not see a problem with this and am requesting a hearing the Home Owners Association. Threats of fines and punishment do not go very far in encouraging me to participate. Please have someone contact me in person if you need a response prior to 11-12-13. Your cooperation and assistance will be greatly appreciated.

The list of Holiday Gardens, Inc. rules they sent me without an effective date on it, states, : '... Maximum dog or cat weight shall not exceed 30 pounds at full growth. No American Pit Bull Terriers, American Staffordshire Terriers, Chows, Rottweiller, Wolf Hybrids, Shepards, any mix of these breeds, or any dog that showns tendency towards aggression.'
